International arrest warrant could spur Gadhafi to fight to the death

On Monday, Luis Moreno-Ocampo, the chief prosecutor of the International Criminal Court (ICC), formally requested an arrest warrant for Libyan leader Moammar Gadhafi. Moreno-Ocampo wants the Libyan strongman charged with having “personally ordered attacks on unarmed Libyan civilians.”

Moreno-Ocampo’s request is being cheered around the world for understandable reasons. But indicting Gadhafi could have the perverse effect of making it harder to bring Libya’s civil war to a quick end.

The ICC was created in 2002 as the permanent predecessor to ad-hoc international justice bodies like the International Criminal Tribunals for Rwanda and Yugoslavia. The basic idea was a good one - leaders who commit genocide, war crimes, and crimes against humanity deserve to be punished. The ICC’s mandate kicks in when it is clear that national legal systems won’t bring a leader with blood on his hands to justice.

Oddly enough, neither the United States nor Libya is a party to the Rome Statute, which created the ICC. (President Bill Clinton signed the treaty in 2000, President George W. Bush “unsigned” it in 2002, and the U.S. Senate has never formally considered it let alone consented to it.)

The United States and Libya, as well as the roughly four dozen other countries that are not party to the treaty, worry that it will interfere in their legal systems or provide an opportunity to harass their citizens.

The 114 countries that have signed onto the Rome Statute, which includes every country in Europe, agreed to cooperate with the ICC. That means they are required to arrest anyone indicted by the court and to extradite him or her to The Hague for prosecution.

A decision to indict Gadhafi would mark the second time the ICC has tried to arrest a sitting head of state. The first time came two years ago when the ICC issued an arrest warrant for Sudan’s president, Omar al-Bashir. He was charged with committing genocide in Darfur region.

Al-Bashir, however, continues to run Sudan and travel around Africa and the Middle East. Indeed, members of the African Union so disliked the ICC decision to indict him that they considered withdrawing from the court in protest (so much for the solemnity of a signed treaty obligation).

A three-judge panel of the ICC is now considering Moreno-Ocampo’s request for a warrant. They can grant his request or deny it. But given that al-Bashir continues to flout his ICC indictment, Gadhafi probably isn’t worrying that Interpol will swoop in and read him his Miranda rights.

That does not mean a warrant for Gadhafi’s arrest would be without consequence. It would give him additional reason to dig in his heels. With the threat of arrest and trial in The Hague hanging over his head, he knows he will not have the option given dictators of old - going into exile to Paris (Baby Doc Duvalier) or retreat to Saudi Arabi (Idi Amin).

After all, European governments have hailed the formation of the ICC as a great legal achievement. Which European leader is going to risk angering his or her public by arguing that the ICC warrant should be ignored and Gadhafi allowed to go into exile, even if that might help bring the continued bloodshed in Libya to an end?

And that is the problem. The NATO-led military operation in Libya hits the two-month mark at the end of this week. Both a rebel victory and a stable ceasefire remain out of reach. A diplomatic initiative to persuade Gadhafi to step down offers one way out of the current stalemate. But Monday’s ICC indictment simply gives him another reason to hang on and fight.

      Obama does have blood on his hands. Look at Libya, which will be Egypt 2.0 if Gaddafi loses. We tried to assassinate him so we could present "evidence" against him without a counterargument. Also, the drone attacks in Pakistan, the war in Afghanistan, and the blood of Palestinians for not standing up to Israel (I'll cut him a break on that since he's a little better than others). He's not a peaceful president and anything occurring in the Empire on his watch should be on him.

        At the end of the day, the major sticking point with these international laws comes down to their ability to be enforced and right now, NATO is a largely ineffective presence (especially when compared to the the US). Right now, the US is the global superpower in terms of military power and even if charges were raised against Bush, there would be no feasible way to bring Bush to trial. Even if, NATO was able to charge and ascertain Bush, the US did not agree to the treaty and NATO would be risking a much larger international military conflict which the would inevitably lose.

        well, millions is an exaggeration. hundreds of thousands is accurate. we forget saddam hussein fought the ayotollah for us in iran 20 years before, and bin laden the russians ten years before. they turned against us as allies for some reason, and as a nation, we do need to study that and conclude why. but bin laden signed his own death warrant with his twin towers attack on U.S. soil. iraq is different. bush and his staff of ninnies went way over the line for an agenda that has never been openly disclosed or discussed. saddam wasn't cool if you were in iraq and acting up. i am unaware of any fact that has him mistreating and killing americans; he never did anything here, and was laughing to 60 Minutes a week before we invaded just because of that fact. if someone knows specific crimes against america or americans he did, i would appreciate knowing. i also, whenever it all is said and done, would like to see an impartial international forum review that action by the previous administration. maybe saddam deserved it, and maybe he didn't. because of the lies and false claims, we may never know. and our own troops deserve better when asked to go in the line of fire. no one is braver, but they need to be sent for just cause. always. bin laden was.

    The whole thing is a big debacle. I don't like the guy any more than the rest of the populace, but I think the whole shenanigan is backfiring on all the sides with special interests in the matter. I mean come on. It started out as a "no-fly zone." Then it became a "no-fly zone plus." Then we just started taking out "tactical" targets to enforce the no-fly zone. Then we decided to train the rebels. Then we decided to arm them, too. Then we decided to bomb the place into next week. Now, since none of the above have worked, and public interest in the matter is running foul, the ICC issues an arrest warrant? I mean come on. That's funnier than a Mark Twain book.

    I don't agree at all with what went on in Libya. I have a bad time to accept the credibility of the ICC, as it brings an indictment against Gaddafi, his son and his brother-in-law, while it lets others go and get away with murder.
    As I had been victim of a miscarriage of justice and suffer from the trauma of an erroneous ruling, I have basically lost my fate in judiciary.

    Another useless international organization which does nothing but look good on paper – if that. The President of Sudan travels freely around Africa and in all those countries there that signed this treaty yet not a ONE of them has arrested him, in fact they protested that he was indicted at all. And what is done about that? Not a thing because this organization has no real power and only the jurisdiction others give it when they feel like it. It's a good thing Bush "unsigned" this and that Congress has never ratified it because it 1) doesn't work and 2) they would probably want us to foot their bill.

    Pinochet was arrested on the principle of universal jurisdiction. Al Bashir and Gaddafi would be limited in their area of travel to the third world countries that embrace them often because of the leaders' military and economic support. They risk arrest whenever they travel and the longer and more effectively the ICC issues indictments the more of a deterrent factor the institution will have in the future. Moreover, the indictment comes after negotiations to get Gaddafi to leave for exile failed.

    I couldn't disagree more. The ICC and the Hague WCT are a great tool to disuade authoritarian regimes and dictators from unleashing hell on their people once their despotic rule is challenged by the masses.

    Any comparison between Obama and Gaddhafi comes from either total ignorance or purposeful incitement. The U.S. does not PURPOSEFULLY target civilians (as Gaddhafi has threatened and acted through time after time) and hire mercenaries from RUSSIA and SERBIA to come terrorize U.S. citizens on our soil! I am sick and tired of hearing about "state sovereignty" as an excuse to do NOTHING when genocide and mass murder is perpetrated by governments! Sovereignty is a fluid concept that continues to adapt to the contemporary realities and should not give shelter to madmen like Saddam, Gaddhafi, Miloshevich, and Janjawed Militia!

    This opens a Pandora's box for arrest leaders of any nation. Actually, it cracks me up. Are they picking and choosing now? What about any official that has launched a missile of some sort. Are they really trying to stop "War" from being declared. Are they going to arrest leaders of Hamas, Israel, the US, South and North Korea, Afghanistan leaders, Pakistan, Al Quada, and How about Syria?....... etc? How far up the food chain will they go? Where would arresting stop if it actually ever gets started? Does "The Hague" really have a big enough military to pull this off? If the idea is for peace, this isn't a way it is going to happen.

      I agree with this comment. How can the ICC pick and choose who should be arrested or not when I would bet that most of the leaders in the world could be considered as committing "crimes against humanity" depending on who you ask. But I guess it's all about who has the power makes the rules, and it depends on whether or not the ICC has the power to carry out such an arrest that will determine if this means anything at all.

      But like American Citizen said, if peace is the goal, or the safety of Libyan civilians is the goal, then this will likely do more harm than good.

It is total hipocracy to seek arrest, or prosecution of another nations leader, when the US President is committing whole sale murder/genocide on people, societies, cultures, factions, etc... across the globe. The investigating bodies are extremely biased and discriminatory in their application of the warrants. They don't have the balls to indict W, or others within the US.

    I don't think indicting Gadhafi will make much difference to him either way. It's pretty clear he's going to hang on either way. After all, he has few places to go, and, even if he does find a country that will take him, that nation is going to face enormous pressure to hand him over to either the ICC, Libya, or another country for prosecution.

    However, indicting him could have some beneficial effects. The people below him could be offered deals in exchange for offering evidence against him. Not only will that strengthen the case against Gadhafi, but it might also serve to destabilize his government. I doubt all the people associated with his regime are ready to go down with him. Many, given the right mix of threats and incentives, could cut and run. And if enough of them desert him, his regime could collapse.

      As I recall, Obama has been pushing high speed rail as an alternative to all the cars on the road, with south Florida being a test market, but Rick Scott said no. In fact, many Republicans are dead set against the idea because they consider any sort of public transit to be socialism.

      And how exactly is he supposed to force these companies to do anything without getting Congress to pass laws requiring them to do so? And, with so many members being in big oil's back pocket, don't hold your breath.
